Terms of Service

These Terms of Service (this "Agreement") govern your use of My Study Buddy App (the "Service"), available at my-study-buddy-app.com. My Study Buddy App is operated by Robert Russell, 105 Banks Station #1281, Fayetteville, GA 30214, United States. You can reach us at mystudybuddyappsupport@gmail.com or 470-980-4658.

My Study Buddy App is for parents and legal guardians aged 18 or older. You create the account, you add your children's profiles, and you are responsible for everything that happens under your account, including the access codes you give your children. Keep your password and your children's codes private.

By creating an account, you represent that you are at least 18 years old and the parent or legal guardian of each child whose profile you add, with authority to consent on that child's behalf to this Agreement and to our Privacy Policy. Children do not create accounts. A child signs in only with a code that you generate and share with them.

New accounts include a 14-day free trial. Before a child's profile becomes active and before we collect information from or about the child, we obtain your verifiable consent through a two-step email confirmation. Once consent is obtained, the trial includes full access to the parent dashboard and kid mode. When the trial ends, access stops until you subscribe. Your data is kept for up to six (6) months, as described in our Privacy Policy, so that subscribing later picks up where you left off.

Two plans are offered: $10 per month, which renews automatically each month, and $60 per year, which renews automatically each year. Prices are in US dollars. Applicable sales tax is calculated and shown at checkout.

Your subscription renews automatically at the then-current price until you cancel. You may cancel at any time from the billing page in the app; cancellation takes effect at the end of the period you have already paid for, and you keep access until then.

Before, or within three (3) days after, each renewal charge, we will send you notice by email confirming that your subscription has renewed or is about to renew at the then-current price, stating the length of the renewal period, and providing a link to cancel. If you are on the annual plan, we will also send you notice by email no less than thirty (30) and no more than sixty (60) days before your renewal date, stating that your subscription will automatically renew unless you cancel and explaining how to cancel.

Payments are no longer refundable once a period has begun. If a payment fails, we may retry it and may suspend access until it succeeds.

We may change prices with at least 30 days' notice by email; the new price applies at your next renewal, and you may cancel before then.

My Study Buddy App generates practice questions, lessons and quizzes using artificial intelligence, based on what you tell us your child's class is working on. Generated content can contain mistakes, and it may not match your child's actual class, teacher, curriculum or upcoming test. Please review what your child sees. If you believe generated content is inappropriate, inaccurate, or otherwise objectionable, you can report it to mystudybuddyappsupport@gmail.com and we will review it.

My Study Buddy App is a practice aid. It is not tutoring, not a school service, not an assessment, and it is not affiliated with, endorsed by, or connected to any school, district, publisher or program named in the app.

Do not use My Study Buddy App to break the law, to upload other people's personal information, to attempt to access other families' data, to resell or redistribute generated content as your own product, or to interfere with the service. We may suspend or terminate accounts that do.

You keep ownership of what you enter that is yours to own, such as child names and your own notes. For material you upload that may belong to someone else (such as a photo of a teacher's handout) you represent that you have a reasonable, good-faith basis to believe you may share it with us for the purpose of generating practice content, and that doing so does not violate any policy of your child's school or district known to you. You grant us permission to process it in order to run the service for you. Generated practice content is yours to use for your family's personal, non-commercial study.

The service is provided "as is" and "as available", without warranties of any kind to the fullest extent permitted by law. We do not promise particular grades, test results or academic outcomes.

To the maximum extent permitted by law, our total liability for any claim relating to the service is limited to the greater of the amount you paid us in the 12 months before the claim or $50, and we are not liable for indirect, incidental, special, consequential or punitive damages. Nothing in this Section limits our liability for gross negligence, willful misconduct, or any liability that cannot be limited under applicable law.

We may update these terms. If a change is material, we will ask you to accept the new version the next time you sign in, and your acceptance is recorded. You may stop using the service at any time. We may end or suspend your access for a breach of these terms or if we stop offering the service, in which case we will refund any unused prepaid time.

These terms are governed by the laws of the State of Georgia, without regard to conflict-of-law rules.

Any dispute arising out of or relating to these terms or the Service will be resolved by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, except that either party may bring an individual claim in small-claims court. For thirty (30) days after you first agree to these terms, you may opt out of this arbitration agreement by emailing mystudybuddyappsupport@gmail.com with your name and account email. If you opt out, disputes will instead be resolved in the state or federal courts located in Fayette County, Georgia. You may only resolve disputes with us on an individual basis, and may not bring or participate in a class, consolidated, or representative action.

We may assign or transfer this Agreement, in whole or in part, without your consent, including to any corporation, limited liability company, or other entity that we form or that otherwise succeeds to the operation of the Service, or to an acquirer in connection with a merger, acquisition, or sale of assets. This Agreement will bind and inure to the benefit of our permitted successors and assigns. You may not assign or transfer this Agreement or your account without our prior written consent.
